    Aubrey Smith is an associate in Winston & Strawn’s New York office who focuses his practice on labor and employment litigation and counseling. Mr. Smith has experience representing clients in class and collective actions as well as in individual claims involving wrongful termination, harassment, discrimination, retaliation, and wage and hour violations. His class and collective action experience includes representing a class of women in a gender discrimination case against an international pharmaceutical company, representing a class of deputy U.S. Marshals in a race discrimination case against the Marshals Service, and representing a group of workers in a nationwide collective action alleging wage and hour violations. Mr. Smith also has experience litigating fraudulent lending and consumer protection matters, including a multi-party case alleging fraudulent lending against a nationwide bank. Prior to joining private practice, Mr. Smith was an honors attorney with the U.S. Department of Transportation (DOT) and clerked for Hon. Robert G. James, chief judge for the U.S. District Court, Western District of Louisiana. While at DOT, Mr. Smith successfully represented the DOT in multiple employment discrimination cases before the U.S. Equal Employment Opportunity Commission (EEOC) Office of Federal Operations, an adjudicatory body within the EEOC. He also led investigations of violations of the DOT’s consumer protection regulations and successfully negotiated a consent order for violation of these regulations. As a federal law clerk, Mr. Smith managed all aspects of litigation in a wide variety of cases, focusing on dispositive motions in civil cases. Mr. Smith received his B.A., summa cum laude, from the University of Georgia in 2008, and he received his J.D. from Duke University School of Law in 2011 where he was editor-in-chief of the Duke Forum Law & Social Change and a staff editor for the Duke Journal of Constitutional Law & Public Policy.
